Here's the latest edition of MOC's Desktop Councilor, an email newsletter aimed at keeping you up-to-date on MOC activities and programs that impact your business. Thank you for your continued membership support.

As reported MOC has been tracking a number of new state legislative proposals related to energy and Oilheating. It is a very busy time on Beacon Hill and legislative committees have announced dates for important public hearings this spring and fall. On May 1st, the Joint Committee on Telecommunications, Utilities and Energy will begin debate on 70 bills and MOC will offer supporting and opposing testimony on a number of measures. MOC will voice strong opposition to House Bill 3335 by State Representative J. James Marzilli (Arlington). Although this bill would develop a fund to provide efficiency services for home heating oil consumers using advice from dealers and service technicians, it would require a one cent per gallon tax on the sale of #2 fuel oil at the wholesale level. MOC understands the burden this type of proposal could have on companies in an already volatile market. The Senate has also written similar legislation and MOC will oppose those bills as well. MOC may be seeking dealer help in writing to a number of legislators to voice opposition to the bills. To view the full text version of these bills and more please click the link below.

In addition to attending the legislative hearing on May 1st, MOC staff will be meeting with Senator Stephen Brewer to examine his legislation regarding the a proposed requirement for continuing education of oil burner technicians. Brewer's bill, Senate 171, would implement new regulations requiring the renewal of certifications for technicians every two years. MOC wants Senator Brewer to know that the Oilheat industry already has extensive continuing education courses for technicians through NORA and that passing new laws may not be necessary.
Reforming LIHEAP (Low Income Home Energy Assistance Progam) will be a top priority when MOC heads for Washington next week. On Thursday, April 26th MOC will join many of New England's Oilheat representatives and the Petroleum Marketers Association of America (PMAA) for Capitol Hill visits with state Congressional delegations. MOC's Michael Ferrante will be accompanied by Jim Townsend (Townsend Oil & Propane), Ed Noonan (Noonan Energy), and Jim Collura and Shane Sweet from NEFI. The team will meet with many members of the Massachusetts Congressional team and will hold a very important LIHEAP meeting with Ron Carlton, the Deputy Director of Health, Education, Labor and Pensions (HELP) Committee, in the office of Senator Ted Kennedy. The team will explain the need for drastic changes in the LIHEAP law, specifically the leveraging mechanism used by states to create programs like Margin-Over-Rack.
Once again MOC has teamed up with NORA and the Martin Agency to launch new radio advertising this spring and fall. The Intelligent Warmth spots will first be heard on May 21st on Boston, Springfield, Cape Cod, Pittsfield and Worcester stations. During two six week flights, 40 percent of ads will be heard during the 'AM drive', 40 percent during the 'PM drive' and 20 percent devoted to midday, evening and weekend spots. After a break through the summer the fall ad series will begin on September 4th and run through October 14th. The Martin Agency is still reviewing possible radio stations in each region to ensure the most effective presence across the state.
Tracy Richmond of COCARD Processing has informed MOC of credit card reduction rates only available to fuel oil dealers. COCARD has worked along side NEFI and other state associations in lobbying for these benefits. The following memo from COCARD is an important message for dealers paying high credit card processing fees:

Visa Rate Reduction Takes Effect

If you are processing on the proper credit card platform, you should have been notified by your processing company that you will be receiving a Visa rate reduction in the middle of April. If you have not yet been notified, your processing company is most likely not familiar with the Heating Oil Industry and the unique programs available.

Tracy Richmond of COCARD has informed us that this change was announced in November of 2006 and will take effect the middle of April 2007. This reduction goes hand-in-hand with the drastic MasterCard reductions also announced in September of 2006.

The new change, combined with the MasterCard reduction already in place, could save the average heating oil dealer thousands of dollars in processing fees and unnecessary expenses. While EVERY other industry in the country is complaining about high processing fees, Oil Heat Dealers are seeing another reduction. This marks the third time in three years that Heating Oil Dealers have been eligible to receive rate decreases!
